Terms & Conditions for booking with Liliano Artistry
LILIANO ARTISTRY – TERMS & CONDITIONS
1. DEFINITIONS “Client”: The person or entity making the booking. – “Artist”: Liliano Artistry and any contracted team members. – “Services”: Hair styling, makeup application, trials, bridal services, event services, or related work performed. – “Booking Fee” / “Deposit”: The 20% non-refundable, non-transferable payment required to secure your booking. – “Event Date”: The confirmed date of your wedding or special event. – “Bridal Party”: Any individual receiving services under the same booking
2. BOOKING FEE / DEPOSIT (20%) 2.1 A non-refundable and non-transferable **20% Booking Fee** is required to secure your date. 2.2 A booking is **not confirmed** until the Booking Fee has been received. 2.3 The Booking Fee is **not a part-payment for services**. It is a **genuine pre-estimate** of loss and costs incurred by the Artist at the time of booking, including but not limited to: – administrative work including quotations, communication, scheduling, and invoicing – reservation and exclusive blocking of the Event time/date – system and calendar management – operational business costs – loss of opportunity by declining other bookings for the same time/date 2.4 In accordance with Australian Consumer Law, this Booking Fee is structured to reflect genuine business costs and loss and is therefore **legally retainable**. 2.5 The Booking Fee is strictly **non-refundable** and **non-transferable**, regardless of: – change of mind – change of circumstances – cancellations – rescheduling – reduction in services – illness (unless the Artist is the party cancelling)
3. PAYMENT SCHEDULE 3.1 The remaining balance (80%) is due no later than the date stated on your invoice, 1 week prior. 3.2 Failure to pay by the due date may result in cancellation of your booking, with the Booking Fee forfeited. 3.3 Additional fees (travel, early start, parking, second artist fees, etc.) must be paid prior to the Event Date.
4. CLIENT CANCELLATIONS 4.1 If the Client cancels at any time, the **20% Booking Fee is forfeited**. 4.2 If the Client cancels **within 90 days** of the Event Date: – the full remaining balance becomes immediately payable, as the Artist may be unable to fill the date. 4.3 Reducing services without replacement of another person is considered a **partial cancellation**, and the original total amount remains payable within 90 days. 4.4 This policy complies with ACL, which states a business may retain fees that reflect genuine operational and administrative loss.
5. CANCELLATION BY THE ARTIST 5.1 In the unlikely event the Artist must cancel due to illness, emergency, or conditions outside reasonable control: – all payments will be refunded ASAP. 5.2 The Artist will make reasonable efforts to arrange a replacement stylist/artist, but cannot guarantee availability.
6. RESCHEDULING 6.1 Any request to reschedule is subject to availability. 6.2 Rescheduling is treated as a cancellation unless the Artist approves the new date. 6.3 The Booking Fee remains **non-refundable and non-transferable** for all reschedule requests initiated by the Client unless approved by the Artist.
7. MINIMUM BOOKING REQUIREMENTS 7.1 Weekend bridal bookings may require a minimum call-out amount or minimum number of services. 7.2 If the Client does not meet the minimum number, they agree to pay the minimum equivalent.
8. TRAVEL, PARKING, TOLLS & EARLY START FEES 8.1 Travel is charged at the current per-kilometre rate specified by the Artist as per Government guidelines. 8.2 Parking, tolls, over night accommodation, away from home/meal allowance or unexpected travel costs must be covered by the Client where specified. 8.3 Early start fees apply to bookings commencing before 6:00am.
9. SECOND ARTIST / ASSISTANT FEES 9.1 If an additional artist is required, the Client must pay the quoted second artist fee. 9.2 This fee is payable upfront and is used to secure the additional artist’s date. 9.3 If the Client later removes services requiring the second artist, the second artist fee remains payable as they have reserved the date and potentially lost alternative work.
10. HEALTH & HYGIENE POLICIES 10.1 Services may be refused to any individual displaying contagious illness including but not limited to: COVID-19, conjunctivitis, cold sores, lice, staph infections, open wounds. 10.2 These policies are in place to ensure safety of the Artist, future clients, and equipment hygiene. 10.3 Cancellations due to illness within 90 days require payment in full unless a replacement person is found.
11. CLIENT RESPONSIBILITIES 11.1 The Client must ensure all participants follow ALL preparation instructions provided by the Artist, penalties apply at $100/hour charged in 15 minute increments for all delays including lateness to appointment, wet/dirty hair and removal of previous makeup application. 11.2 Delays caused by the Client or bridal party may result in incomplete services, with no entitlement to refund. 11.3 Children must be supervised at all times with any/all damages to be paid for by the client. A separate invoice will be sent post-appointment for any breakages/damages.
12. ALLERGIES & SKIN CONDITIONS 12.1 All allergies, sensitivities, and skin conditions must be disclosed prior to the appointment. 12.2 The Artist is not responsible for reactions where conditions or allergies were not disclosed.
13. PHOTOGRAPHY & MEDIA USE 13.1 The Artist may take photographs of the completed work for marketing purposes unless the Client opts out in writing prior to the appointment. Most images will be taken for the clients memories/documentation and sent after the booking has been completed. 13.2 The Artist maintains copyright over all images taken.
14. FORCE MAJEURE 14.1 The Artist is not liable for cancellations caused by events beyond control such as extreme weather, natural disaster, sudden client illness/injury or government restrictions. 14.2 Payments may be credited at the Artist’s discretion.
15. LIABILITY 15.1 The Artist is not responsible for: – allergic reactions where disclosure was not made – environmental factors affecting hair or makeup – not listening to instructions on how to care for hair and makeup after application – injuries occurring due to venue or Client conditions – delays caused by the Client or any third party – Removal or altering the final look after the client has approved total satisfaction with the Artist. 15.2 Liability is limited to the total amount paid, excluding the Booking Fee, plus any legal fees (if any)
16. ELECTRONIC CONTRACTS & DIGITAL SIGNATURES 16.1 The Client acknowledges that all agreements, acceptances, invoices, approvals, or signatures completed electronically (including email confirmation, online forms, digital signatures, or payment of the Booking Fee) are legally binding under Australian law. 16.2 Electronic contracts are enforceable in NSW under the Electronic Transactions Act 2000 (NSW) and are treated the same as handwritten signatures. 16.3 By paying the Booking Fee, signing digitally, or confirming acceptance electronically, the Client enters a legally binding contract with Liliano Artistry.
17. ACCEPTANCE OF TERMS 17.1 By paying the 20% Booking Fee, the Client acknowledges and agrees to all terms and policies. 17.2 The Client acknowledges the Booking Fee is reasonable, non-refundable, non-transferable, and represents genuine business costs and loss under ACL.
